Electricity Ordinance Disciplinary Tribunal Panel
The Panel
Pursuant to Section 38 of the Electricity Ordinance (Chapter 406), the disciplinary tribunal panel is established of which the panel members are appointed by the Secretary for Environment and Ecology. Not more than 5 persons are appointed from each of the following categories -
- corporate members of the Hong Kong Institution of Engineers;
- tertiary educational institutions;
- organizations that he considers represent the interests of registered electrical contractors;
- organizations that he considers represent the interests of registered electrical workers; and
- organizations that he considers are representative of or promote the interests of owners of commercial, industrial or domestic electrical installations.
A member shall be appointed for a term of 3 years and may be reappointed at the end of a term.
The Powers
- The disciplinary tribunal may, by notice under the signature of the chairman of the disciplinary tribunal -
- order a person to attend before the tribunal and give evidence;
- order a person to produce documents; and
- authorize a person to inspect an electrical installation.
- After concluding its hearing, the disciplinary tribunal may exonerate the registered electrical worker or contractor or may do one or more of the following -
- reprimand the worker or contractor;
- fine a worker up to $10,000 and a contractor up to $100,000;
- suspend or cancel the registration of the worker or contractor;
- suspend the worker's or contractor's right to apply for registration or renewal of registration for a specified period of time.
- The disciplinary tribunal may make any order it thinks fit with regard to the payment of costs of the proceedings under Section 41 of the Electricity Ordinance and the costs of the Director of Electrical and Mechanical Services or of the registered electrical worker or contractor
